Severe Reaction or Injury from a Vaccine?
Every day adults and children around the world are safely vaccinated against disease and illnesses. Unfortunately, some patients do experience severe and debilitating reactions to vaccinations.
This is why Congress created the National Vaccine Injury Compensation Program; to help victims of vaccine reactions. However, bringing a claim in the federal court that adjudicates these cases is a complicated, adversarial procedure. Specialized United States Department of Justice attorneys represent the federal government in opposing claims for compensation resulting from vaccine injuries. These attorneys practice exclusively in the area of vaccine injury and have the resources of the United States government behind them. The United States Court of Federal Claims, the federal court that hears vaccine injury cases has procedures that are quite different from almost all other United States state or federal courts. You need an experienced vaccine attorney to help you recover financial compensation.
How we can help
Our representation in vaccine injury cases comes no cost to you. Our legal fees never come out of any money awarded to you. Instead, our fees are paid separately by the United States Court of Federal Claims at the conclusion of the case pursuant to federal law.
We understand that individuals injured by adverse vaccine reactions do not have money to spare. Therefore, our Firm pays the costs of litigating your case, such as expert physician fees, medical records copying charges, filing fees, and the other costs of litigating your claim. At the conclusion of the case our Firm seeks repayment of those costs from the Court.
We endeavor to have one of our attorneys travel to meet with you at or near your home regardless of where you live. We strongly believe that this is crucial to our Firm being able to effectively represent you. You must meet your attorney and we must meet our client. Obviously, if your case goes to trial, we will likely meet with you again or even multiple times to prepare you for testifying.
If your case goes to trial, the trial should take place close to where you live. When Congress created the Vaccine Program, one of the legislative compromises was that the Court would travel to injured patients to adjudicate their case. Furthermore, when it is necessary for your physician to testify at trial, it is simply not possible to require them to travel and thus the hearing needs to be convenient to their office.
We understand that our clients need compensation for their injuries, and often just as importantly need that compensation quickly. We have had multiple cases where a rapid resolution of a case makes the difference between the family of an injured breadwinner moving forward with their lives or the family ending up broken-up and homeless. Sometimes it is possible for us to move the process quickly to accomplish a rapid resolution and, unfortunately, sometimes it simply isn’t. However, we endeavor to perform our work as efficiently as possible to obtain our clients the compensation they deserve as rapidly as litigation of a vaccine case allows.
